4. Definizioni

 

• “Contratto di commercio elettronico”: contratto avente per oggetto beni o servizi stipulato tra il fornitore (gestore del sito) e un cliente ovvero consumatore in un sistema di vendita o prestazione di servizi a distanza con l’impiego di una o più tecniche di comunicazione telematiche;
• “acquirente”: cliente (soggetto passivo IVA) ovvero consumatore persona fisica ex art. 3 Dlgs n. 206/2005, cioè la persona fisica che compie l’acquisto per scopi non riferibili all’attività commerciale o professionale eventualmente svolta;

Anche se cerchiamo di mostrare con esattezza i colori dei nostri prodotti sul sito, i colori reali dipendono dal monitor e dalla risoluzione dello schermo. Per questo, non possiamo garantire che i colori visualizzati dal monitor siano identici ai colori dei prodotti al momento della consegna. Quindi:

• Le variazioni nei processi di confezionamento, le impostazioni del tuo monitor e la scheda video possono modificare l’aspetto dei tessuti e dei prodotti, quindi è possibile che i prodotti consegnati siano leggermente diversi a quelli mostrati e descritti sul sito;
• Tutti i prodotti/tessuti di GREG S.r.l. sono soggetti a disponibilità, pertanto non sempre è possibile realizzare tutti gli ordini. In questi casi, il cliente sarà informato il più presto possibile qualora un prodotto ordinato non fosse disponibile secondo le specifiche richieste e, se lo accetta, verrà offerto un prodotto alternativo di qualità equivalente, superiore o dello stesso valore con le specifiche richieste dal cliente;
• È importante considerare che gli ordini:

1.sono confezionati solo se riceviamo l’autorizzazione al pagamento dalla banca dei clienti, con previa conferma di tutte le condizioni di acquisto.

    2.verranno spediti soltanto se i capi, realizzati correttamente,  avranno superato il meticoloso controllo qualità di GREG S.r.l..

GREG S.r.l. offers tailor-made clothing and accessories made to order and made to measure for both men and women. In such cases, the customer will be informed as soon as possible if an ordered product is not available according to the specifications requested and, if he accepts it, an alternative product of equivalent quality will be offered, higher or of the same value with the specifications requested by the customer;
• Please keep in mind that your order:

1. will only be processed if you have placed the order correctly and we received authorization from your payment card.
2. will be shipped only if the garments, properly made,  have passed the meticulous quality control of GREG S.r.l..

6. Prezzi e modalità di pagamento

 

Tutti i prezzi di vendita dei prodotti esposti e indicati sul sito egrarchivio.com  sono espressi in Euro e costituiscono offerta al pubblico ai sensi dell’art. 1336 c.c..

Se acquisti dall'Unione Europea e, pertanto, i nostri prodotti verranno consegnati nell'Unione, le tasse sono incluse.

Non accettiamo ordini da acquirenti all'interno dell'Unione Europea effettuati in valute diverse dall'Euro.

Per tutti gli altri paesi le tasse non sono incluse. Al di fuori dell'UE, il prezzo visibile sul sito egrarchivio.com è da considerarsi escluso da tasse, dazi e altre tasse governative. Effettuando un ordine, il cliente si impegna a pagare eventuali tasse o costi di sdoganamento.

Le spese di spedizione sono a carico dell’acquirente, salvo non sia espressamente indicata la gratuità in caso di promozioni.

Al Cliente sarà consentito scegliere una delle seguenti modalità di pagamento: tramite carta di credito, prepagata, PayPal, bonifico bancario, Bitcoin.

Il Fornitore non assume alcuna responsabilità per l’eventuale uso fraudolento e illecito che  possa essere fatto da parte di terzi,delle carte di credito e altri mezzi di pagamento all’atto del pagamento dei prodotti commissionati e acquistati.

Il Contratto si perfeziona al momento del pagamento, mediante l'invio della conferma d'ordine al cliente.

6. Prices and payment method

 

All sales prices of the products displayed and indicated on the site egrarchivio.com, are expressed in Euro and are offered to the public pursuant (art. 1336 CC ).

If you are buying from the European Union and, therefore, our products will be delivered in the Union, taxes are included.

We do not accept orders from customers within the European Union placed in other currencies than Euro.

For all other countries taxes are not included. Outside the EU all fees charged by GREG S.r.l. is to be considered excluded of any taxes, duties or other governmental levies or any financial charges. By placing an order, the customer agrees to pay and be responsible for any taxes, duties, levies or charges for the use of the Transaction Services in addition to our service fees.

Shipping costs are charged to the buyer, unless free of charge is expressly indicated in the website in case of promotions.

The customer will be allowed to choose one of the following payment methods: by credit card, prepaid, Paypal, bank transfer, Bitcoin

The Supplier assumes no responsibility for any fraudulent and illicit use that may be made by third parties, credit cards and other means of payment at the time of payment of the products ordered and purchased.

The Contract is concluded at the time of payment, by sending the order confirmation to the customer.

 

7. OBBLIGHI DELL’ACQUIRENTE

Il Cliente dichiara e garantisce: (i) di essere un consumatore secondo quanto previsto all'art. 3 del Codice del Consumo; (ii) di essere maggiorenne; (iii) che i dati dallo stesso forniti per l'esecuzione del Contratto sono corretti e veritieri.

L’acquirente si impegna  a pagare il prezzo del bene commissionato e acquistato nei tempi e modi indicati dal contratto. L’acquirente si impegna, una volta conclusa la procedura di acquisto online, a provvedere alla stampa e conservazione del presente contratto qualora lo reputi necessario. Le informazioni contenute in quasto contratto sono state peraltro già visionate e accettate dall’acquirente che ne dà atto, in quanto questo passaggio viene reso obbligatorio prima della conferma di acquisto.  

7. OBLIGATIONS OF THE BUYER

The Customer declares and warrants: (i) to be a consumer in accordance with art. 3 of the Consumer Code; (ii) to be of legal age; (iii) that the data provided by the same for the execution of the Contract are correct and truthful.

The buyer undertakes to pay the price of the goods ordered and purchased within the time and manner specified in the contract. Once the online purchase procedure has been completed, the buyer undertakes to print and keep this contract if he considers it necessary. The information contained in this contract has already been examined and accepted by the purchaser who acknowledges it, as this passage is made mandatory before the purchase confirmation.

 

8. Tempi e modalità di spedizione e consegna. Limitazioni di responsabilità

Il tempo di consegna medio è di 28 giorni lavorativi dalla data del pagamento. La data di consegna indicata è una data stimata e non garantita. Infatti, a causa di fattori esterni, la data di consegna potrebbe essere diversa dalla data inizialmente indicata. La GREG S.r.l. garantisce la consegna eccetto in situazioni, eventi o circostanze fuori dal proprio controllo (ovvero: cliente assente, condizioni meteorologiche, errori nelle informazioni per la spedizione, ritardi imputabili ai corrieri, procedimenti legali, interruzione per festività del servizio dei corrieri, interruzione del processo di confezionamento per Festività ovvero nei periodi di chiusura per ferie – queste ultime  indicativamente dal 23/12 al 10/01, durante le Festività Pasquali, dal 30/07 al 05/09-  etc...). 

8. Limitations of liability

The average delivery time is 28 working days from the payment date. The provided delivery date is an estimated date and not an ensured one. Due to external factors, the delivery date could be different from the confirmed date. GREG S.r.l guarantees delivery except in situations, events or circumstances that are beyond our control (i.e.: absent customer, weather conditions, errors in shipping information, delays attributable to couriers, legal proceedings, interruption of the courier service due to public holidays, Interruption of the packaging process during public holidays or in the closing periods for holidays – the latter indicatively from 23/12 to 10/01, during the Easter Holidays, from 30/07 to 05/09-  etc...).

9.  Politica post-vendita – eccezione al diritto di recesso

 

L’Acquirente non può esercitare diritto di recesso, perchè ai sensi e per gli effetti dell’art. 59 lettera C del Codice di Consumo, l’oggetto del contratto saranno beni confezionati esclusivamente dietro specifiche richieste e chiara personalizzazione di ogni singolo acquirente. La personalizzazione riguarderà a titolo esemplificativo, ma non esaustivo: la scelta del modello, la scelta del tessuto, della fodera e dei bottoni, l’applicazione di iniziali ricamate a mano...

Pertanto, ogni capo realizzato sarà unico e conseguentemente per la GREG S.r.l. assolutamente insuscettibile di rimessa in vendita ad altro consumatore/acquirente. 

 

9. After-sales policy - exception to the right of withdrawal

 

The Purchaser cannot exercise the right of withdrawal, because pursuant to art. 59 letter C of the Consumer Code, the subject of the contract will be goods packaged exclusively upon specific requests and clear customization of each individual buyer. The customization will cover for example, but not exhaustive: the choice of the model, the choice of fabric, lining and buttons, the application of initials embroidered by hand...

Therefore, each item will be unique and consequently for GREG S.r.l. absolutely unsuskeptical of sale to other consumer/ buyer.

10. Cancellazione dell’ordine

GREG S.r.l. permette la cancellazione di un ordine solo entro 24 ore dall' acquisto. Dopo questo termine, GREG S.r.l. non offre la possibilità di cancellare l’ordine poiché la sua produzione è già iniziata e si incorrerebbe in costi irrecuperabili (tessuti, tempo del sarto, ecc.)

10. Cancellation of the order

GREG S.r.l. only allows cancellation of an order if it has been made within 24 hours. After this time span, GREG S.r.l., can no longer cancel the order as its production has begun and costs incurred (fabrics, tailor time, etc.)

11. Modifiche e correttezza del contenuto

GREG S.r.l. si riserva il diritto di effettuare, senza previo avviso, le modifiche che considera opportune sul suo sito, potendo cambiare, eliminare o aggiungere contenuti o servizi forniti attraverso il sito, come la forma in cui vengano presentati o localizzati sul suo sito, per il suo miglioramento o rinnovamento.

11. Modifications and accuracy of the content

GREG S.r.l. reserves the right to make unannounced changes in its Website when considered as appropriate, change, delete or add content and services provided through the same, as well as the way in which they are presented or located on the Website for its improvement and renewal.

In nessun caso GREG S.r.l.  concede licenza, rinuncia, trasmissione, cessione totale o parziale di suddetti diritti né conferisce alcun diritto, né possibilità di ottenerlo, soprattutto riguardo ad alterazione, trasformazione, sfruttamento, riproduzione, distribuzione o comunicazione pubblica dei suddetti contenuti senza la previa autorizzazione espressa e scritta di  GREG S.r.l.o dei titolari corrispondenti. L’utente può usare il sito e il suo contenuto esclusivamente per uso personale e privato. Qualsiasi altro uso sarà proibito e necessiterà la previa autorizzazione espressa e scritta da parte di GREG S.r.l.. GREG S.r.l.s’impegna ragionevolmente a garantire che questo sito sia privo di virus o altri malware. The User can only use the Website and its contents for personal and private use. Any other use is prohibited and will require the User to obtain the prior written permission of GREG S.r.l.. La giurisdizione sarà quella del Foro in cui il Cliente ha la propria residenza o domicilio, se ubicati nel territorio dello Stato italiano, o del Foro di Torino, qualora il Cliente abbia la propria residenza o il proprio domicilio all'estero.

19. Applicable jurisdiction

 

The relations between a client and GREG S.r.l. is governed by the Italian laws . The jurisdiction shall be that of the Court in which the Customer has his residence or domicile, if located in the territory of the Italian State, or the Court of  Turin, if the Customer has his residence or domicile abroad.
